Definitions

Norwegian NeLS Galaxy Sites or “the Galaxy Service”: any one of the Galaxy sites provided to you by the partner universities of Elixir Norway, including but not limited to:

Use of Service.

The Norwegian NeLS Galaxy Sites are a free, public, Internet accessible resource (the “Service”) for Norwegian Life Scientists and their collaborators. Data transfer is encrypted. Data storage is not encrypted. If there are restrictions on the way your research data can be stored and used, please consult your local institutional review board or the project principal investigator before uploading it to any public site, including this Service. Your access to the service may be revoked at any time for reasons deemed necessary by the operators of the Service.

You acknowledge that you are responsible for compliance of all of your data processing activities carried out on the Galaxy Service with applicable laws and regulations of Norway, as well as any laws or regulations of other legislations or any other restrictions that might be applicable due to the provenance, intended use, legal ownership of or any licensing or other legal restrictions imposed on the data being processed.

You are strictly prohibited from making use of the Galaxy Service for the storage or processing of any Personal Data or Sensitive Personal Data as defined by the European Union’s General Data Protection Regulation (GDPR), including but not limited to potentially personally identifying medical data.

Accounts and Service Limitations

To use the Service, a user account will be automatically registered with the Service upon first time login with your FEIDE identity or your NeLS IdP identity. Your registration data is primarily used so you may persistently store data on the Service and use advanced Galaxy features such as sharing and workflows. The operators of the Service will not provide your registration data to any third party unless required to do so by law. Your access to the Service is provided under the condition that you abide by any published quotas on data storage, job submissions, or any other limitations placed on the public Service. Attempts to subvert these limits by creating multiple accounts or through any other method may result in termination of all associated accounts.

  • Data handling

    • The Galaxy service should only be used for temporary storage of data while performing analyses, and files should thereafter be downloaded or moved to another storage supporting service or archive, such as the NeLS Storage.
    • Data that have not been actively used for 3 months, will be addressed with notifications to responsible users to clean up their Galaxy datasets and histories.
    • The Service does not have any backups of your uploaded data, so the Galaxy server should not be considered a safe place for data storage. We take no responsibility for accidental loss of data (see Limitation of Liability section below as well).
    • Data marked by the User for deletion in the Galaxy Service interface, will be permanently removed after 30 days, and thus not possible to recover anymore.
    • “Abandoned data” which is older than 1 year and not recently accessed may be deleted without notice.
    • The default storage quota is 200 GB, but it is possible to apply for more storage if this is absolutely necessary in order to perform certain analyses.

  • Service availability

    • If the server needs maintenance for an extended period (for instance in relation to upgrades), users should be given notice at least 7 days in advance.
    • Shorter downtimes that are only expected to last a few minutes and don’t affect running jobs (e.g. Galaxy reboots), can be done with 15 minutes advance notice and will be scheduled during periods of low use whenever possible.
    • Notifications will be posted on the front page of Galaxy and/or sent via Galaxy’s internal notification system. Notifications of maintenance will not be provided via email.

  • Response time to requests

    • ELIXIR Norway operates during regular business hours during weekdays, and aims to respond to all service requests within 3 working days.

The Service is provided to you on an “AS IS” BASIS and WITHOUT WARRANTY, either express or implied, including, without limitation, the warranties of non-infringement, merchantability or fitness for a particular purpose. THE ENTIRE RISK AS TO THE QUALITY OF THE SERVICE IS WITH YOU. This DISCLAIMER OF WARRANTY constitutes an essential part of this service agreement.

Limitation of Liability

Under no circumstances and under no legal theory, whether in tort (including negligence), contract, or otherwise, shall the University of Bergen (UiB), University of Oslo (UiO), University of Tromsø (UiT), The Norwegian University of Science and Technology (NTNU) or the Norwegian University of Life Sciences (NMBU) or any other entity which provides resources for the Service be liable to anyone for any indirect, special, incidental, or consequential damages of any character arising as a result of the use of this Service including, without limitation, damages for loss of goodwill, work stoppage, computer failure or malfunction, or any and all other commercial damages or losses. This limitation of liability shall not apply to the extent applicable law prohibits such limitation.
